An IP registry could undermine, as well as protect, Māori knowledge

A database of mātauranga Māori could stop incorrect patenting of material that uses Indigenous knowledge, but a study based on interviews with Māori innovators outlines both the potential and risks of such a system. While interviewees said a registry could protect mātauranga and even help with commercialisation, they also pointed out risks like third parties using it as a source of ideas, and exposure to AI. The authors say there can be a 'fundamental discord' between te ao Māori and a Western IP model. They emphasise that Māori perspectives are diverse and complex and any decisions must be Māori-led, drawing on the many relevant communities.

"There's a common misconception that Māori interests in intellectual property are mostly about stopping others from misusing Mātauranga. That defensive framing is only part of the story.

"The innovators we interviewed, working across te ao Māori, were eager to use IP tools for both protection and commercialisation. But current discussions around registries of indigenous knowledge miss both goals. Conceived from within a Western IP framework, registries are designed to service the IP system, and in doing so, they cannot hold what actually matters to mātauranga Māori: the whakapapa and hononga that give knowledge its meaning and its life. The more interesting question is what a system designed from within te ao Māori might look like instead."
